Important Bacs rules for businesses

Without exemption, any business that processes Bacs payments, the Bacs scheme rules for Service Users, outlined in the Service User Guide must be followed. If this is not the case, you could face suspension from the scheme, have your Service User Number (SUN) revoked by your sponsoring bank, or potentially receive financial penalties and losses.

The key Bacs rules that businesses must follow are:

  • Obtain a valid Direct Debit Instruction

A Direct Debit Instruction (DDI) must be completed with or by the customer on paper, over the phone or online using advised wording and involve the customer’s explicit authorisation or signature approving the payment.

Once this authorisation has been made, the DDI can be submitted to the customer’s bank to start the Direct Debit set up process.

  • Give advance notice

Your business must give the customer enough advance notice before a payment is taken for the first time or if the payment amount, date or frequency change. This advance notice is typically around 10 working days in most circumstances.

  • Honour the Direct Debit Guarantee

All of your documentation and communications with your customers about Direct Debit payments must include content from the Direct Debit Guarantee which has to be honoured.

The Direct Debit Guarantee contains three main protections:

  • Advance notification of any payment changes for customers.
  • Customers are entitled to a full and prompt refund for any payment taken in error or at breach of any Bacs compliance rules.
  • Payments can be cancelled at any time by the customer contacting their bank. If any payment is taken after a cancellation, customers are entitled to a refund.

 

  • Submit accurate files

Direct Debit payment files that are submitted to Bacs must be accurate and filed on time. This means that enterprises processing Bacs payments should monitor payment details and ensure these are consistently checked and updated. This includes all the relevant account information, KYC checks and file formats must be Standard 18.

  • Maintain precise records

A clear and transparent payment record trail and tracking system is essential to ensure you stay compliant with Bacs scheme rules and deal effectively with payment queries or disputes.

A lack of compliance with Bacs rules can be serious for your business and could have lasting consequences for the longevity of your operations.

Bacs scheme non-compliance could result in:

  • Financial penalties: A Direct Debit that is taken but subsequently proved to be invalid due to cancellation, fraud or error will have to be repaid to the customer in full. There may be additional bank charges you are also required to pay.
  • Operational suspension: Bacs could stop your ability to collect Direct Debit payments from customers if an audit confirms scheme breaches.
  • Business interruption: A cancellation of services could severely impact your financial standing and reduce the flow of cash into your organisation. This could hamper future planning and financial liquidity.
  • Reputational damage: A business that is known to be non-compliant with Bacs scheme rules risks breaking customer loyalty and trust which can have long-lasting effects on brand reputation.
